When there is a channel with one subtitle available, the app shows two options, off or on.
When there is a channel without subtitles available, the app shows two options, off or on.
When there is a channel with more than one subtitles available, the app shows off and the options of the language available.
This is the intended behavior. When there are no subtitles, you can still turn it on because the setting is remembered. If the program changes and subtitles are available, it will start to show them.
When that the VLC shows that doesn’t exist any subtitles in a channel and impossible to choose, the Channels app shows an option for turn on.
When there is an one subtitle in a channel, I want to see the language subtitles that available and not option of on or off.

The problem still exists in the beta.
Is there something new?
This is fixed in the latest beta. It will always show the language.
